Berkeley County Property Records Terms of Use

These terms apply when you visit or use Berkeley County Property Records. By continuing to use the site, you agree to the conditions below; stop using it if you do not accept them.

1. What This Website Is

Berkeley County Property Records is a private information service about deed, tax, assessment, and parcel resources for Berkeley County, West Virginia. It links to government records but does not host those records, and it is independent of the County and every court and public office.

2. Rules for Using This Site

Use this site and anything learned through it only in ways allowed by law. In particular, you may not:

  • Stalk, harass, intimidate, threaten, or harm any person
  • Commit deed fraud, identity theft, or any other fraud
  • Make FCRA-regulated decisions (credit, employment, tenant, insurance)
  • Scrape, copy, or republish the site's content at scale
  • Interfere with the site's operation or security

3. We Are Not a Consumer Reporting Agency

Neither this site nor its search tools is a consumer reporting agency under the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.). Site material and third-party search output are not consumer reports and cannot be used to determine eligibility for credit, employment, housing, insurance, or another purpose covered by that law.

4. Not Title, Survey, or Legal Advice

Looking up property records is not the same as completing a title examination or surveying a boundary, and the information is not legal advice. Consult a title company, licensed surveyor, or attorney for those professional services; this reference cannot replace them.

5. Links to Outside Sites

Each government portal and outside provider, including a sponsored search service, sets its own rules. We do not control those sites or accept responsibility for their content, uptime, charges, or handling of submitted data.

6. No Warranties

This reference is supplied on an “as is” and “as available” basis, without warranties. We make no promise that information is complete, accurate, or current, or that an external link will remain available or return a particular result.

7. Limits on Our Liability

To the fullest extent permitted by law, the site operators are not liable for direct or indirect losses, incidental or consequential damages, or special damages connected with this site, an external resource, or a decision based on information found through either.

8. Indemnification

If your unlawful use of the site or breach of these terms leads to a claim, you agree to defend and hold the site operators harmless, including for reasonable legal fees where allowed.

9. Intellectual Property

Copyright protects the site’s original writing, logo, design, and layout. You may link to a page or quote a short passage with credit, but may not republish full pages or copy material systematically without permission.

10. Changes to These Terms

We can revise these conditions by posting a replacement version on this page. Using the site after that posting signifies acceptance of the new terms.

11. Governing Law

West Virginia law governs these terms, without applying its conflict-of-law rules. The state Freedom of Information Act, W.Va. Code §29B-1-3, concerns requests made to public-body record custodians; it does not make this privately operated reference site a custodian of Berkeley County records.

12. Severability

If a court finds one provision unenforceable, all remaining provisions continue to apply.
